Terms of Service
Last updated: 29 October 2026
These Terms of Service (“Terms”) apply to your access to and use of the RhoHMS website, software platform, and related services (together, the “Services”). By accessing or using the Services, you agree to these Terms. If you use the Services for a hotel or other organization, you confirm that you are authorized to accept these Terms on its behalf.
1. The Services
RhoHMS provides hospitality management tools that may support property operations, reservations, guest services, reporting, and related workflows. Features may vary by subscription, configuration, location, and the agreements applicable to your account.
We may update or modify the Services to maintain, improve, or protect them. Where a change materially affects paid Services, we will provide notice where reasonably practicable and as required by applicable law or a separate agreement.
2. Accounts and Access
You must provide accurate account information and keep it reasonably current. You are responsible for safeguarding your credentials, limiting access to authorized users, and activity performed through your account.
Notify us promptly through the official contact details published on our website if you suspect unauthorized access or a security incident involving your account. We may suspend credentials where reasonably necessary to protect the Services, users, or data.
3. Acceptable Use
You must use the Services lawfully and only for their intended business purposes. You must not:
- Use the Services in a way that violates applicable law or another person's rights.
- Attempt to gain unauthorized access to accounts, systems, or data.
- Interfere with or disrupt the integrity, availability, or security of the Services.
- Upload malicious code or content that you do not have the right to provide.
- Reverse engineer or circumvent technical restrictions, except to the extent applicable law permits.
- Use the Services to transmit unlawful, misleading, or abusive material.
4. Customer and Hotel Responsibilities
If you use RhoHMS to manage a property, you are responsible for your staff's use of the Services, the accuracy and lawfulness of information you enter, and the decisions you make using the Services.
You must provide appropriate notices and obtain any permissions or lawful bases required to collect and process guest, employee, or other personal information. You are also responsible for configuring user roles and access permissions appropriately and for maintaining any records you are legally required to retain.
5. Personal Information
Our Privacy Policy describes how personal information is handled through the website and Services. When a hotel or business customer provides guest or staff data, that customer remains responsible for its own privacy obligations. RhoHMS may process that data on the customer's behalf as described in the Privacy Policy and any applicable agreement.
6. Fees and Payment
If a subscription or paid feature is offered, the applicable prices, billing period, payment terms, and renewal or cancellation rules will be stated in the relevant order, subscription flow, or separate written agreement. You agree to pay fees that you have accepted under those terms.
Taxes, if applicable, will be handled as stated in the relevant pricing or order terms. If there is a conflict between this section and a signed order or service agreement, the specific agreement will govern that conflict.
7. Third-Party Services
The Services may connect to or link to third-party products, websites, or providers. Those services are governed by their own terms and privacy practices. RhoHMS is not responsible for third-party services that it does not operate, and your use of them is at your discretion.
8. Intellectual Property
RhoHMS and its licensors retain their rights in the Services, including associated software, design, branding, and documentation. These Terms give you a limited, non-exclusive, non-transferable right to use the Services for their intended purpose during your authorized access.
You retain rights to information and content you submit. You grant RhoHMS permission to host, process, and use that content only as reasonably necessary to provide, secure, and support the Services, comply with law, and perform any applicable agreement.
9. Availability and Support
We aim to provide reliable Services, but we do not guarantee that they will be uninterrupted, error-free, or available at every time or location. Maintenance, technical issues, connectivity, third-party services, or events outside our reasonable control may affect availability.
Support, service levels, backups, and recovery commitments apply only where expressly provided in an applicable service agreement or plan.
10. Suspension and Termination
You may stop using the Services at any time. If your access is provided under a subscription or separate agreement, that agreement governs cancellation and termination.
We may suspend or restrict access where reasonably necessary to address a security risk, comply with law, protect users or the Services, or respond to a material breach of these Terms. Where practicable, we will provide notice and an opportunity to address the issue. Upon termination, your right to access the Services ends, subject to any data export, retention, or deletion terms in an applicable agreement and legal requirements.
11. Disclaimers
To the extent permitted by applicable law, the Services are provided “as is” and “as available.” We do not make warranties that are not expressly stated in these Terms or an applicable written agreement. Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.
The Services provide operational tools and information; they do not replace your professional judgment or legal, accounting, safety, or other specialist advice.
12. Limitation of Liability
To the extent permitted by applicable law, neither party will be liable to the other for indirect, incidental, special, consequential, or punitive loss, or loss of profits, revenue, business opportunity, or goodwill arising from use of the Services.
To the extent permitted by applicable law, RhoHMS's total liability arising from or related to the Services will not exceed the fees paid or payable by you for the Services giving rise to the claim during the twelve months before the event giving rise to liability. These limits do not apply where liability cannot lawfully be limited, or to liability that an applicable written agreement expressly excludes from the limit.
13. Indemnity
To the extent permitted by applicable law, you agree to be responsible for third-party claims and costs arising from your unlawful use of the Services, your breach of these Terms, or content and personal information you provide without the necessary rights or permissions. This does not apply to the extent a claim results from RhoHMS's own breach or misconduct.
14. Changes to These Terms
We may update these Terms to reflect changes to the Services, our operations, or legal requirements. We will update the “Last updated” date when changes are made and provide additional notice where required by law. Your continued use after updated Terms take effect means you accept them, to the extent permitted by applicable law.
15. General
If a provision of these Terms is found unenforceable, the remaining provisions will continue to apply to the extent permitted by law. A failure to enforce a provision is not a waiver of the right to do so later. These Terms, together with any applicable order or written service agreement, describe the terms governing your use of the Services. If they conflict, the applicable order or written service agreement controls for that conflict.
